Description
On the basis of international law and subject to their treaty obligations, states have the right to control the entry of foreign nationals into their territories. However, when dealing with individuals seeking international protection, a state’s margin of appreciation is narrower. In this case, indeed, the freedom of each sovereign should be exercised in accordance with human rights standards and should guarantee the highest level of protection. After discussing the development of human rights and asylum policies in the European Union, this paper examines Directive 2003/9/EC of 27 January 2003, laying down the minimum standards for the reception of asylum seekers in the light of human rights obligations and tries to determine whether this legal instrument contributed to the establishment of the Common European Asylum System. In addition, assessment of Commission’s proposals will be provided in order to establish whether future amendments will be essential in providing asylum seekers with the highest level of protection and in setting common standards in the EU reception area.

On 3 October 2013, 366 migrants drowned when their boat sank less than a mile off the shore of the Italian island of Lampedusa. A number of questions must be addressed in finding the best policy response to this tragedy. Was it the sign of a new trend in irregular migration to the EU; or was it a sign of increased risks associated with smuggling? Do smuggled migrants resemble regular asylum seekers and migrants or do they represent a specific group? In other words do the Lampedusa events call for a drastic revision of EU asylum and migration policy or an ad hoc response?

Description
Indian and Chinese nationals comprise two of the largest foreign-born nationality groups in the United States - and are growing rapidly. Indian and Chinese immigrants tend to enter the United States through skilled migration channels - either pursuing further education, or entering on temporary work visas for specialty occupations - and go on to enjoy higher employment rates and higher median household incomes than the US-born population. Despite these successes, these groups still face some integration challenges, like cultural integration and English language proficiency. Immigrant integration services in the United States are relatively decentralized, with crucial services provided by a wide array of actors. Federal funds are usually directed and supplemented by state and local government actors; who then work closely with civil society organizations, including Indian and Chinese diaspora groups, to provide support in areas like social services, language training, credential recognition, and naturalization assistance. Meanwhile, India and China are starting to expand their diaspora engagement activities to include integration services at destination.

Protection against statelessness : trends and regulations in Europe

Description
This report presents the normative background, analytical frame and key findings of the Database on Protection Against Statelessness in Europe, developed by the EUDO CITIZENSHIP Observatory in partnership with the UNHCR Statelessness Unit. The database, which was launched in March 2013, includes information on the extent to which citizenship laws in 36 European states provide sufficient protection against statelessness, in light of the most important international standards. The database is organized around a comprehensive typology of modes of protection against statelessness which outlines, in a systematic way, 17 categories of persons that are at risk of being or becoming stateless. The database is unique in its systematic comparative approach, its comprehensive geographical scope and its interactive search functionality. The database allows users to view all relevant regulations within one country or to compare different regulations across 36 European countries. For each regulation we provide precise information on provisions in national legislation, including hyperlinks to relevant laws, as well as a critical assessment, against the normative background of established international norms.
